ZONING BOARD OF ADJUSTMENT

Meeting of July 15, 2009

 

Present:  Myra Mansouri, Chair.  Peggy Pschirrer, David Calhoun, Mary Therese Lester, and Alternates – Bill Webb, Ernie Vose and Jan Galloway Leclerc.

Absent:  Leo Carignan

Acting Chair Peggy Pschirrer opened the meeting at 7:30 PM.

 

 

The Chair Myra Mansouri opened the meeting at 7:30 p.m.   There were no members of the public present.

 

MINUTES:

            It was moved by Mary Therese Lester to waive the approval of the June minutes until the next meeting.  Dave Calhoun seconded the motion and it was so voted.

 

ANNOUNCEMENTS:  

 

            The Chair distributed several articles with Court Updates regarding cases and legislative updates regarding zoning issues.   Copies of the Amended By-laws were also distributed.

 

            Ms. Mansouri announced the Planning Board moved to recommend the Select Board deny a permit to Merriam Farms to build.   At a later meeting the Select Board voted to grant the permit.

 

            A letter was delivered to the Select Board from the Zoning Board of Adjustment recommending the tin ceiling be replaced with an acoustical ceiling when the first floor ceiling is repaired.          

 

NEW BUSINESS:

 

There was no new business.

 

OLD BUSINESS:

           

The Zoning Board briefly reviewed the following proposed Amendment to Article VII, Industrial District.  A discussion will be held at Augusts’ meeting.

           

ARTICLE VII

 

INDUSTRIAL DISTRICT

 

 E. Special Exceptions

 

1) Commercial operations by Special Exception from the Board of Adjustment under the same provisions as apply to the use permitted under Article VI, the Commercial District.

 

            a) Consideration of Planning Board Recommendation on the project based on its

            determination following a public hearing, that:

 

                        i) property currently zoned for commercial operations is either                                             unavailable or inadequate for the proposed use;

                       

                        ii) the proposed use is appropriate and consistent with the Town’s Master

                        Plan

 

            b) Each proposed use must show it will not infringe on the primary established       use of the district.

 

            c) No commercial venture or use shall be permitted which could cause any undue   hazard to health, safety or property values or which could be offensive to the    public because of noise, vibration, excessive traffic, unsanitary conditions,      noxious odors, smoke, or other similar reason.

 

            d) All signs shall meet the requirements of Part D of the General Provisions of       the Zoning Ordinance.

                       

 

 

David Calhoun moved to adjourn the meeting at 8:207 PM.  Seconded by Mary Therese Lester.   All in Favor.
