MEETING OF THE SELECTBOARD

APRIL 29, 2010

 

Selectboard Present:     Whitney Aldrich (Chair); Jamie Teague, Sheldon Sawyer

 

Mr. Aldrich called the meeting to order at 7:30 PM with four people present in the audience.

 

PUBLIC BUSINESS:

HOOPER HILL HOPPERS SNOWMOBILE CLUB:  Marcia Galloway advised that they need to supplement their applications for work that is needed on the trails.  There are two places on Town roads:  1) Between the Reservoir and Old Drewsville Road because a new bridge needs to be put in; and 2) there is a minor problem on the Halls Crossing Trail that needs to be taken care of.  They have to submit a separate “Grant In Aid Project” document to the NH Department of Resources and Economic Development / Division of Parks and Recreation / Bureau of Trails for each project that is undertaken.  The contact person has to be a member of the Selectboard.

Mr. Sawyer moved that the Chairman sign the required paper work to allow the work to be done on the trails.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

USE OF LIQUID MANURE:  Mrs. Teague read a memo she had written to Mr. Neary regarding the “Complaint about Liquid Manure and Enforcement of Zoning Regulations in a Residential Neighborhood”, dated April 29, 2010.  She further stated that “Contrary to popular belief, she is in favor of farming and conservation that being said she personally feels that people have a right to certain expectations and protections afforded by law; she also believes that people should be able to use their land how they want within reason.”  Mr. Neary expressed a concern that he does not want it said that he is opposed to farming in Walpole.  He had a farm for 25 years.  Mr. Sawyer apologized to Sue Bauer for his son using a different manure on their field.  It was noted that the odor from liquid manure is stronger than solid manure.    

Mrs. Teague moved to rescind the vote taken two weeks ago on April 15, 2010 based on the Agriculture RSAs at the State level.  Seconded by Mr. Aldrich.  With Mrs. Teague and Mr. Aldrich in favor, the motion was approved.  Mr. Sawyer abstained from the vote.

 

ACCOUNTS PAYABLE:  Mr. Sawyer moved to approve the Accounts Payable check register and manifest in the amount of $32,483.95.  Seconded by Mrs. Teague.  Motion passed unanimously.

It was noted that a majority of the above amount is a payment for the Health Insurance. 

 

Mrs. Teague moved to approve payment of the voucher request for $20.00 out of the Fanny Mason Forest Trust Fund for one package of Walpole trash bags to collect trash at the Route 12 rest areas.  This will be charged to the Trustees of Trust Funds.  Seconded by Mr. Sawyer.  Motion passed unanimously.

 

Mrs. Teague moved to approve the Annual Maintenance contract for the amount of $533.61 with Oce’ North America to take care of the downstairs copier.  Seconded by Mr. Sawyer.  Motion passed unanimously.

 

PAYROLL:

Mr. Sawyer moved to approve the payroll voucher for the week ending April 24, 2010, for checks dated April 30, 2010, for gross wages in the amount of $16,726.30 or net wages in the amount of $8,727.14.  Seconded by Mrs. Teague.  Motion passed unanimously.

Mrs. Teague moved to approve the electronic fund transfer for the 941 Employer Taxes for Withholding, MEDI and FICA taxes in the amount of $3,925.82. Seconded by Mr. Sawyer.  Motion passed unanimously.

 

MINUTES:

SELECTBOARD MEETING – April 22, 2010:  Mr. Sawyer moved to approve the Minutes of the Selectboard meeting of April 22, 2010, as printed.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

BUILDING PERMITS:

GORTON, 26 Goldsmith Tavern Road, Walpole, Map & Lot #003-022-000:  Mr. Sawyer moved to approve Building Permit No. 2010-17 for Shirley and Aquilla Gorton to build a 10’ x 11’ addition onto the existing home.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

SIMPKINS, 20 Firehouse Road, Walpole, Map & Lot #024-027-000:  After reviewing the Building Permit document there was a consensus of the Selectboard that Darren and Tammy Simpkins will have to submit an application to the Zoning Board of Adjustment for a Variance unless they make a decision to build the garage in accordance with the same footprint or build in the back part of their property.

 

PRIMAX PROPERTIES, LLC., 8 Red Barn Lane, Walpole, Map & Lot #011-012-000:  The Selectboard acknowledged receipt of this Building Permit but put it “on-hold” subject to it being processed through the customary steps. 

 

TIMBER:

INTENT TO CUT:  MONTGOMERY, 114 Ramsey Hill Road, Walpole, Map & Lot #011-091-000:  Mr. Sawyer moved to approve the Intent to Cut Timber for Mr. Charles Montgomery.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

ABATEMENT / REFUND:

McAULIFFE, 1021 Main Street, North Walpole, Map & Lot #028-091-000:  Mrs. Teague moved to approve the Notice of Property Tax Abatement Refund in the amount of $1,726.96 for Gerald & Hania McAuliffe and James & Nancy McAuliffe.  This is the result of a decision by the Board of Tax and Land Appeals on the appeal for tax years 2007, 2008 and 2009.  Seconded by Mr. Sawyer.  Motion passed unanimously.

 

NEW BUSINESS:  None.

 

OLD BUSINESS:

MONADNOCK CONSERVANCY, Paul Galloway Easement:  Mr. Sawyer moved to take Option I for the Town’s interest in the Galloway property in that the Town will retain an interest so in the event that the Monadnock Conservancy does not perform their duties the Town can take it over.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

LETTER FROM THE WALPOLE POLICE DEPARTMENT – RE: Thomas Murray:  The Selectboard acknowledged receipt of a copy of the letter from Police Chief David Hewes to Thomas Murray.

 

WALPOLE VILLAGE SCHOOL BINGO:  During the last meeting Mr. Sawyer and Mr. Aldrich discussed a request from the Walpole Village School to utilize the Town Hall every last Tuesday of the month for

bingo.  They have these bingo nights to raise money for the school.  Mrs. Clinger questioned if their $25.00 deposit fee could be rolled forward for each month providing there is no damage after each bingo night and if they should be charged the $25.00 fee for rental as they are raising money for the school.  A decision was made to pass over making a decision until a full Board was present.  Mrs. Teague noted that since the Walpole Village School is a private school the taxpayers should not be asked to support it. 

Mrs. Teague moved that since the Walpole Village School is a private school they should be charged the $25.00 fee for rent as they are raising money for the school.  The $25.00 fee will be used for the Town Hall electricity and heat.  There will be no additional charge for use of the kitchen.  Seconded by Mr. Sawyer.  Motion passed unanimously.

 

FINALIZE AUDIT:  Mr. Sawyer moved to write a letter to the Auditors to request that they finalize the audit.  Seconded by Mrs. Teague.  Motion passed unanimously.

 

POTATO BARN PROPERTY:  Mrs. Clough received an email from Cliff Harper relative to the Potato Barn property.  He advised that they are waiting to meet with the Town Attorney.  Mr. Sawyer noted that the Selectboard received their legal opinion from Attorney Hockensmith.  If Mr. Harper wants to meet with the Town Attorney he will have to make his own arrangements at his own expense. 

 

MERRIAM FARM ROAD:  Mr. Sawyer did a site visit to monitor the work being done on the Merriam Farm Road; a Class VI road.  He saw no further erosion.  No trees have been cut in the Town’s right-of-way but they are ready to do so.   Mr. Sawyer talked with Mr. Keurulainen, President of Merriam Farm, Inc. The owners have submitted their plans for the restoration.  They have stayed within the stone walls, which is the Town’s right-of-way, for the cutting.

 

LETTERS TO BE SIGNED:

CHIEF DAVID C. HEWES – Vacation Request:  Mr. Sawyer moved to grant Chief Hewes request to take a week off as vacation time.  Lieutenant Paquette will be in charge.  Seconded by Mrs. Teague.  Motion passed unanimously.       

 

NON-PUBLIC SESSION – RSA 91-A:3 II:

Mrs. Teague moved to enter into a Non-Public session pursuant to RSA 91-A:3 II to discuss (d) Reputations.  Mr. Sawyer seconded the motion and, on a roll call vote with all in favor, the motion was approved.  The time was 9:00 PM.

 

The regular meeting resumed at 9:14 PM.

 

Town Hall:  Mrs. Teague moved that the Selectboard draft a letter to the Walpole Players regarding the proper usage and sharing of the upstairs facilities in the Town Hall.  Seconded by Mr. Sawyer.  Motion passed unanimously.
